OPT OUT AGREEMENT

To be completed by the business's primary account holder. You are requesting to opt out of the Merchant Trust Initiative. Please review the following terms before submission to withdraw from the program.

  1. You were enrolled in the Merchant Trust Initiative (MTI), which helps clients improve cybersecurity, protect their data and meet their Payment Card Industry Data Security Standard (PCI DSS) obligations.
  2. You have requested to withdraw from the initiative.
  3. In doing so, you acknowledge that:
    1. Eway has provided you with information about the initiative, PCI DSS and the risks of cyber attack;
    2. Meeting PCI DSS is a mandatory obligation of accepting credit card payments, and a contractual requirement of your agreement with us;
    3. These obligations remain, even if you outsource payment processing to Eway or another party;
    4. In leaving the MTI, you will not have access to the tools and support that are part of this initiative;
    5. If you do not maintain PCI DSS compliance and suffer a data breach, you may incur fines from the Card Schemes, experience restrictions on your payment processing, have your account canceled and/or be added to a list of banned merchants; and
    6. You may also incur penalties for breaches of privacy laws and regulations.
  4. You agree to do the following:
    1. Complete a Self Assessment Questionnaire (SAQ) annually and implement the 12 PCI DSS requirements;
    2. Report to us any account data breaches immediately;
    3. Upon request, provide evidence of compliance with PCI DSS.
